- On December 5, 2002, a Judge 1n Williamson County, Illinois approved a class action lawsuit against the largest auto insurance provider in the United States.
- The insurer was accused of breaching it contract with policyholders for pledging in their policies to restore wrecked vehicles to pre-loss condition, or to replace damaged items with those of like kind and quality. (The insurer also faced allegations that its policies violated the state's Consumer Fraud and Deceptive Business Practices Act.)
- The insurer's practice was that whenever it could more cheaply repair a car by using non-OEM parts, it would require any auto mechanic to us the non-OEM parts instead of the OEM parts.
- A prominent law firm in the case made the claim that "non-OEM parts are clearly inferior to OEM parts" and that the insurer, by requiring the use of non-OEM parts, was "violating its agreement to restore people's cars to the condition they were in before the accident."
